By confirming the order on SofaTurkey.com, the Buyer acknowledges having read, understood, and agreed to this Agreement and all related policies (Privacy Policy, Refund & Returns Policy, and Terms of Service).

Article 2 – Scope and Subject

2.1 This Agreement governs the sale of custom-made furniture and related products under the SofaTurkey brand.

2.2 SofaTurkey.com operates internationally and does not provide domestic sales within Türkiye.

2.3 All SofaTurkey products are handcrafted, made-to-order, and produced individually according to the Buyer’s chosen specifications (materials, colors, sizes, designs, and configurations).

Article 3 – Prices, Currency, and Cost Exclusions

3.1 All prices displayed on SofaTurkey.com are denominated in EURO (€).

3.2 The listed prices refer only to the standard version of the product and do not include:

  • Shipping or freight costs,
  • Customs duties or import taxes,
  • Special size or customization fees,
  • Local delivery, assembly, or handling fees,
    unless explicitly stated otherwise in writing by the Seller.

3.3 Shipping, customs, and all other associated costs are borne entirely by the Buyer, unless a separate written agreement indicates otherwise.

3.4 The total amount payable (including optional extras, special dimensions, or custom features) will be communicated to the Buyer in writing before order confirmation.

3.5 Payments shall be made via one of the methods provided on the Website (credit card, international bank transfer, or other supported payment systems).

3.6 Production begins only after full payment is received and confirmed by the Seller.

Article 4 – Production Time and Delivery

4.1 Production time varies depending on:

  • The selected product model,
  • The degree of customization,
  • The quantity ordered, and
  • Current production workload.

4.2 Estimated production and delivery times are communicated to the Buyer before the order is finalized. These are approximate and not guaranteed deadlines.

4.3 In extraordinary circumstances (e.g., material supply delays, international transport restrictions, pandemics, strikes, or force majeure events), production and delivery times may change. The Seller shall inform the Buyer of any such changes as soon as possible.

4.4 SofaTurkey delivers worldwide via international carriers. Delivery times and costs depend on the destination country and chosen shipping method.

4.5 The Seller is not responsible for customs duties, import taxes, or any additional local fees incurred at the destination.

4.6 The delivery obligation of the Seller is fulfilled once the product is handed over to the international carrier. Risk of loss or damage passes to the Buyer at that point.

4.7 If the Buyer refuses or fails to accept delivery, all resulting costs (storage, customs, re-shipment, or return fees) shall be borne by the Buyer.

Article 5 – Custom Production and Non-Return Policy

5.1 All SofaTurkey products are custom-made and produced individually according to the Buyer’s specifications.

5.2 In accordance with Turkish and international consumer protection law, the right of withdrawal does not apply to goods that are manufactured according to the consumer’s personal preferences or clearly customized specifications.

5.3 Therefore, returns, exchanges, or cancellations are not accepted once production has started, except in cases of confirmed manufacturing defects acknowledged in writing by the Seller.

5.4 The Buyer must carefully review all product details, dimensions, and materials before confirming the order. After confirmation, changes can only be made if production has not yet started and only with the Seller’s written consent.

5.5 If the Seller accepts an order cancellation before production starts, any administrative, design, or material procurement costs will be deducted from the Buyer’s refund.

Article 6 – Product Characteristics, Quality, and Warranty

6.1 All SofaTurkey products are handmade using natural materials such as wood, fabric, leather, and metal. Slight differences in color, texture, stitching, or finish are normal and not considered defects.

6.2 The Seller guarantees that the delivered products are free from major manufacturing defects.

6.3 The Buyer must inspect the goods immediately upon delivery and report any visible damages or defects to the shipping carrier and notify the Seller within 48 hours.

6.4 If a manufacturing defect is verified and accepted by the Seller, the Seller may repair, replace, or refund the defective product, at its sole discretion.

6.5 This warranty does not cover damages caused by misuse, negligence, improper maintenance, or normal wear and tear.

Article 7 – Limitation of Liability

7.1 The Seller’s liability is limited to the total amount paid for the relevant order.

7.2 The Seller shall not be liable for indirect, incidental, or consequential losses (including loss of profit, loss of business, or delivery delays due to international transport or customs procedures).

Article 8 – Force Majeure

The Seller shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:
natural disasters, wars, pandemics, embargoes, government restrictions, material shortages, strikes, or logistical disruptions.
In such cases, delivery and production timelines shall be extended accordingly, or the order may be postponed or canceled without liability.

Article 9 – Governing Law and Jurisdiction

9.1 This Agreement is governed by Turkish law, considering international trade and consumer protection principles.

9.2 Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices (Türkiye), unless otherwise required by mandatory consumer law in the Buyer’s country of residence.

Article 10 – Miscellaneous Provisions

10.1 This Agreement, together with SofaTurkey’s Privacy Policy, Refund & Returns Policy, and Terms of Service, constitutes the entire agreement between the Parties.

10.2 The Seller may amend this Agreement without prior notice, provided that such amendments shall not affect orders already confirmed and in production.

10.3 If any provision herein is found invalid or unenforceable, the remaining provisions shall remain in full force.

10.4 All official communications shall be made in writing via email to the addresses provided by the Parties.
